What are DSA and DMA? What do we mean by digital markets and who are affected by these regulations?

The Digital Services Act and the Digital Markets Act were created with the aim of creating a safer digital space. Within the digital markets, their primary objective is to protect the fundamental rights of users and to promote a level playing field for businesses. The European Parliament and the Council are firmly committed to promoting innovation, growth and competitiveness, both in the European single market and globally.

- Social Media
- Content exchange platforms
- App stores
- Apps
The EU is firmly committed to digital transformation, without forgetting the special relevance of fundamental rights online. These laws are configured as a counterweight to the private rules imposed by the “gatekeepers”. The EU creates this category to identify large platforms that control digital ecosystems. In addition, being included in the categories of “very large online platform” or “very large online search engine” implies the obligation to comply with the obligations of the DSA.
On April 23, the 1st list of “gatekeepers” was published, including:
Large online platforms: Alibaba, AliExpress, Amazon Store, App Store, Booking.com, Facebook, Google Play, Google Maps, Google Shopping, Instagram, LinkedIn, Pinterest, Snapchat, TikTok, Twitter, Wikipedia, YouTube and Zalando.
Large Search Engines: Bing and Google
These companies will have to implement improvements in their online services, in order to offer users:
- More training.
- Greater protection for minors.
- Improved content moderation and reduced misinformation.
- Increased transparency and accountability (annual risk assessment)
