Law and 2020: A Difficult Year, But Not the Worst

The right to declare 2020 “the worst year ever” (The worst year ever) by Time magazine is a good headline, but clearly an exaggeration. Although it has not been a good year in many ways, history has known much worse years. Fortunately, this virus was not created by an evil organization as in the movies, but nature is warning us that we cannot continue on this path.

The Beginning of a New Era?

This year will be long remembered. It could mark the end of one era or the beginning of another, like World War I for the 20th century. These social changes will surprise in the future. Many of the transformations we have already experienced are a premonition of what is to come, with some positive aspects and others of real concern.

The task of our generation will be to ensure that the good remains and the bad is mitigated or transformed. The law will also have to adapt to these transformations, since its function is to offer novel responses, based on principles that must not be abandoned.

Constitutional Rights in Times of Pandemic

The pandemic has put to the test many constitutional rights that we considered untouchable. Some measures are necessitated by the situation, while others have been taken to take advantage of the crisis. We will soon need to reflect deeply on their limits and guarantees.

Technology can be a great ally or, on the contrary, a powerful enemy. It is increasingly present in our lives and we must maintain a balance between obligations and rights. This balance must protect the globality of users, offering them a framework that respects both individual and universal rights.
